MyLoverr Affiliate Program Terms & Conditions

This Affiliate Agreement (the “Agreement”) is a legally binding contract between MyLoverr (the “Company”, “We”, “Us”, or “Our”) and the individual or entity applying to or participating in the MyLoverr Affiliate Program (the “Affiliate”, “You”, or “Your”).
By registering for, accessing, or participating in the MyLoverr Affiliate Program, You acknowledge that You have read, understood, and agree to be bound by the terms and conditions set forth in this Agreement.
If You do not agree to these terms, You must not participate in the Affiliate Program.
1. Enrollment
To become an Affiliate, you must complete the registration process and be approved by the Company. The Company reserves the right to accept or reject any application at its sole discretion.
2. Affiliate Links, Coupon Codes & Tracking
Upon approval into the Affiliate Program, the Company may provide the Affiliate, at its sole discretion, with one or more tracking tools, including:
- A unique referral link for tracking conversions;
- A unique promotional coupon code assigned exclusively to the Affiliate;
- A dedicated tracking link that automatically applies the Affiliate’s coupon at checkout (if applicable).
The specific tracking tools provided may vary and are subject to modification or discontinuation at the Company’s sole discretion.
Any referral links, coupon codes, tracking tools, or testing access, if granted, will be sent exclusively to the email address registered in the Affiliate’s account. The Affiliate is solely responsible for maintaining accurate contact information.
The Company shall not be responsible for misdelivery resulting from incorrect, outdated, or inaccessible email accounts.
2.1 Referral Links
The referral link is used to track traffic and qualifying sales generated by the Affiliate. The Affiliate agrees not to modify, obscure, mask, redirect, manipulate, or otherwise interfere with the proper functioning of their referral link.
Any attempt to falsify tracking data or artificially inflate conversions may result in immediate suspension or termination from the Affiliate Program.
2.2 Coupon Codes
If provided, a promotional coupon code is assigned exclusively to the Affiliate for the purpose of tracking eligible sales when entered at checkout.
The Affiliate may not alter, resell, sublicense, publicly distribute, or misrepresent their coupon code in a misleading manner.
The Company reserves the right to deactivate, modify, suspend, or revoke any coupon code at any time, with or without notice.
2.3 Coupon-Based Tracking Links
The Company may provide a dedicated tracking link that automatically applies the Affiliate’s coupon code at checkout. Sales generated through such link will be attributed to the Affiliate, subject to eligibility rules described in this Agreement.
2.4 Optional Testing Access
The Company does not automatically provide testing coupons. However, an Affiliate may request a testing coupon for the sole purpose of verifying platform functionality.
If approved, any testing coupon:
- Will be strictly limited to a single use;
- May not be shared, published, or distributed publicly;
- Will not generate commission;
- May be revoked or denied at the Company’s sole discretion.
Misuse of testing access, including unauthorized distribution, commercial use, or self-referral abuse, may result in immediate suspension or permanent termination from the Affiliate Program.
3. Commission Structure
- Direct Commission Rate: 30% of eligible gross sales generated directly by the Affiliate.
- Second-Tier Referral Commission: 10% of eligible gross sales generated by Affiliates directly referred and approved under the Affiliate.
- Applies only to completed, paid, and non-refunded initial purchases.
- No commission on refunded, disputed, fraudulent, or chargeback transactions.
- Recurring commissions apply only if explicitly stated.
3.1 Second-Tier Referral Commission
An Affiliate may earn a second-tier referral commission when they directly refer an individual who is approved by the Company as an Affiliate.
- The referring Affiliate earns 10% of the eligible gross sales generated by the referred Affiliate.
- The referred Affiliate continues to earn their standard 30% direct commission.
- The second-tier commission does not reduce, split, or affect the referred Affiliate’s commission.
- Second-tier commissions apply only to one level of referral.
- No third-tier, multi-level, cascading, or pyramid-based commissions are provided.
The Company reserves the right to modify, suspend, or terminate the second-tier referral commission structure at its sole discretion with prior notice.
4. Payment Terms
The Affiliate may earn commission based solely on the initial purchase of the following plans:
- Basic Plan – $4.98 USD (Annual Subscription – commission applies only to the first payment)
- Lovers Plan – $6.98 USD (One-Time Purchase)
No commission will be paid on renewals, recurring charges, upgrades, future billing cycles, or reactivations.
4.1 Minimum Payout Threshold
- Minimum payout threshold: $20 USD in approved commissions.
- Commissions are considered approved 8 days after the initial purchase.
- Calculated based on completed, paid, non-refunded initial purchases only.
- Commission rate: 30% of eligible gross sales.
- Second-tier referral commissions are included in the total commission balance for payout purposes.
Examples:
- 1 Lovers Plan purchase ($6.98 × 1 = $6.98)
Commission: $6.98 × 30% = $2.09 → Not yet eligible (must reach $20 USD total and 8 days post-purchase). - Multiple purchases totaling $66 USD
Commission: $66 × 30% = $19.80 → Eligible for payout once total approved commissions reach $20 USD. - Any combination of purchases generating at least $20 USD in approved commission → Eligible for payout after 8 days.
Sales accumulate over time and do not reset monthly. If the threshold is not reached in a given period, the balance carries over until $20 USD in approved commissions is met.
4.2 Commission Eligibility
- Applies only to completed, paid, non-refunded initial transactions.
- Validation period of up to 30 days may apply.
- Refunded, disputed, or chargeback transactions do not count.
4.3 Payment Method
All approved commissions will be paid via PayPal to the email address registered by the Affiliate in their account.
The Affiliate is responsible for ensuring that their PayPal email is valid and active. If the email is incorrect or inactive, the Company is not liable for failed payments.
Payments will be processed once the minimum payout threshold ($20 USD in approved commissions) is reached and 8 days have passed since the qualifying purchase(s).
The Affiliate is solely responsible for all applicable taxes and fees associated with PayPal transfers.
4.4 Payment Request
To receive payment, the Affiliate must submit a payout request directly through their secure Affiliate Dashboard.
Access to the Affiliate Dashboard is provided via a unique access token sent exclusively to the email address registered in the Affiliate’s account upon approval into the Program.
The Affiliate is solely responsible for maintaining the confidentiality of their dashboard access link and token. The Company shall not be liable for unauthorized access resulting from the Affiliate’s failure to secure their credentials.
Payout requests submitted through the dashboard will be reviewed and, if approved, processed within up to 7 days.
The Affiliate is solely responsible for ensuring that their payout details are accurate and up to date. The Company shall not be responsible for delays or failed payments resulting from incorrect, incomplete, or outdated payout information.
5. Prohibited Activities
- Running paid ads using the Company’s brand name (brand bidding)
- Spam marketing (email spam, automated DMs, unsolicited messaging)
- False or misleading claims
- Impersonating the Company
- Publishing coupon codes without permission
- Self-referrals or fraudulent purchases
- Promoting through illegal or explicit adult content
Violation may result in termination and forfeiture of unpaid commissions.
6. Marketing & Disclosure
- Clearly disclose affiliate relationship where required by law.
- Comply with all applicable marketing and consumer protection laws.
- Represent the product truthfully.
7. Intellectual Property
Affiliate is granted a limited, non-exclusive, revocable license to use Company branding solely for promotional purposes.
All intellectual property remains the exclusive property of the Company.
8. Fraud & Abuse
The Company reserves the right to withhold commissions and investigate suspected fraud or abuse. Confirmed violations may result in permanent termination and forfeiture of commissions.
9. Term & Termination
This Agreement continues until terminated.
- Affiliate links and coupon codes will be deactivated.
- Unpaid commissions may be forfeited in case of breach.
10. Limitation of Liability
The Company shall not be liable for indirect, incidental, special, or consequential damages. Maximum liability for any claim arising under this Agreement is limited to the total commissions actually earned by the Affiliate in the 90 days preceding the claim.
11. Modification of Terms
The Company may update or modify this Agreement at any time. Continued participation constitutes acceptance.
12. Independent Contractor
Affiliate is an independent contractor and not an employee, partner, agent, or representative of the Company.
13. Governing Law
This Agreement shall be governed by the laws of BRAZIL.
14. Incorporations & Additional Policies
This Agreement is subject to and incorporates by reference the Company’s Terms of Service and Privacy Policy, as may be updated from time to time.
By enrolling in or participating in the Affiliate Program, the Affiliate agrees to be bound by this Agreement, the Terms of Service, and the Privacy Policy.
15. Acceptance
By participating in the MyLoverr Affiliate Program, you confirm that you have read, understood, and agreed to this Agreement, the Terms of Service, and the Privacy Policy.
16. Modification of Commission Structure
The Company reserves the right, at its sole discretion, to modify, increase, decrease, restructure, suspend, or discontinue commission rates, payout thresholds, eligible products, qualification criteria, or any aspect of the Affiliate compensation structure at any time.
Affiliates will be notified of any material changes via the email address registered in their Affiliate account.
Continued participation in the Affiliate Program following such notification constitutes acceptance of the updated commission terms.
Any changes shall apply prospectively and shall not retroactively affect commissions that were validated and formally approved prior to the effective date of the modification.
17. Chargebacks, Refunds, Disputes & Reversals
Any transaction that results in a refund, dispute, chargeback, reversal, payment failure, or is determined to be fraudulent shall not qualify as an eligible commissionable sale.
Commissions associated with such transactions will be automatically revoked, reversed, or deducted from the Affiliate’s balance.
If commission has already been paid for a transaction that later becomes refunded, disputed, or reversed, the Company reserves the right to:
- Deduct the corresponding amount from future payouts;
- Offset the amount against any pending balance;
- Require reimbursement from the Affiliate if necessary.
The Company reserves the right to investigate suspicious activity and may freeze or suspend Affiliate payouts during such investigation.
The Company’s determination regarding refunds, disputes, chargebacks, and fraudulent activity shall be final and binding.
18. Audit Rights
The Company reserves the right to audit Affiliate records and traffic sources to ensure compliance with this Agreement. Affiliates must cooperate and provide requested documentation promptly.
19. Immediate Suspension
The Company reserves the right to immediately suspend or terminate an Affiliate account in case of suspected fraud, violation of terms, or any activity that may cause reputational or financial harm.
